Terms of Service
Effective Date: March 28, 2026
These Terms of Service ("Terms") govern your use of CaveFinder (cavefinder.app), operated by Buzzy LLC, a New Mexico limited liability company ("we," "us," "our"). By creating an account or using the service, you agree to be bound by these Terms.
1. Service Description
CaveFinder is a terrain analysis tool that identifies potential cave entrances and sinkholes from LiDAR and other digital elevation data. The service analyzes topographic features and produces scored predictions of where cave entrances may exist.
Important: Results are computational predictions based on terrain data, not confirmed cave locations. Many results will be false positives. Always verify candidates through field investigation.
2. Account Requirements
- You must be at least 18 years of age to create an account.
- You may maintain only one account per person.
- You must provide accurate and complete registration information and keep it up to date.
- You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
3. Subscription Tiers and Pricing
CaveFinder offers multiple subscription tiers:
- Free — limited number of analyses with basic features
- Pro — expanded analysis limits, advanced features, and priority processing, available as a paid subscription via Stripe
We reserve the right to modify pricing, features, or tier limits with at least 30 days advance notice to affected subscribers. Feature availability may change as the service evolves.
4. Billing and Cancellation
- Pro subscriptions are billed on a recurring basis (monthly or annually) through Stripe.
- You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of your current billing period.
- No refunds are provided for partial billing periods. You will retain access to Pro features through the end of your paid period.
- If payment fails, we may downgrade your account to the Free tier after a reasonable grace period.
5. Acceptable Use
You agree to use CaveFinder only for lawful purposes and in accordance with these Terms. Specifically, you must not:
- Use the service for any commercial purpose during the early access period without prior written authorization. The service is intended for personal, non-commercial research use during early access.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the detection methodology, scoring algorithms, or analysis techniques used by CaveFinder.
- Redistribute, resell, sublicense, or publicly share the detection methodology or scoring systems.
- Use automated scripts, bots, or scrapers to access the service or extract data.
- Resell, redistribute, or commercially exploit analysis results without authorization.
- Circumvent or attempt to circumvent rate limits, tier restrictions, or other usage controls.
- Use the service to harass, stalk, or infringe on others' property rights.
- Interfere with or disrupt the service or its infrastructure.
6. Safety Disclaimer
CAVING IS INHERENTLY DANGEROUS AND CAN RESULT IN SERIOUS INJURY OR DEATH.
CaveFinder provides computational predictions about terrain features. These predictions are not guarantees of cave existence, accessibility, or safety. By using this service, you acknowledge and agree that:
- You are solely responsible for your personal safety and the safety of anyone in your party.
- You must obtain explicit permission from landowners before entering private property. You must obtain any required permits or access authorization before entering public lands.
- You must have proper caving training, equipment, and experience before entering any cave or sinkhole.
- You assume all risk associated with field visits to locations identified by CaveFinder.
- CaveFinder results do not constitute an invitation or authorization to enter any property.
- Many predicted locations will not contain caves. Some locations may contain hazards including but not limited to unstable terrain, flooding, wildlife, poor air quality, and vertical drops.
- You should follow responsible caving practices and report significant finds to your local grotto rather than posting locations publicly.
7. Intellectual Property
All detection methods, algorithms, scoring systems, weighting formulas, and analysis techniques used by CaveFinder are proprietary trade secrets of Buzzy LLC. All rights are reserved.
You retain ownership of your saved results, field notes, and any data you upload to the service. By uploading data, you grant us a limited license to process it solely to provide the service to you.
The CaveFinder name, logo, and related marks are trademarks of Buzzy LLC.
8. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUZZY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or death arising from use of the service or reliance on its results
- Property damage or trespass claims
- Inaccurate or incomplete analysis results
- Loss of data, profits, or business opportunities
- Service interruptions or downtime
IN NO EVENT SHALL BUZZY LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO BUZZY LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Buzzy LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the service, your violation of these Terms, or your violation of any third-party rights (including property rights and privacy rights).
10. Data Accuracy and Third-Party Data
CaveFinder relies on elevation data from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this data. Third-party data sources include:
- USGS 3D Elevation Program — public domain, United States government work
- OpenTopography — various datasets including Copernicus DEM and SRTM
- Copernicus DEM — provided by the European Space Agency (ESA) under the Copernicus license
- JAXA ALOS World 3D — provided by the Japan Aerospace Exploration Agency
- OpenStreetMap — public cave location data provided under the Open Database License (ODbL). © OpenStreetMap contributors.
Use of third-party data is subject to the respective providers' terms and licenses. We make no representations regarding the accuracy of any third-party data.
11. Termination
- We may suspend or terminate your account at any time if you violate these Terms, with or without notice depending on the severity of the violation.
- You may delete your account at any time through the in-app account settings or by contacting [email protected].
- Upon termination, your right to use the service ceases immediately. We may delete your account data in accordance with our Privacy Policy.
- Sections 6 (Safety), 7 (IP), 8 (Liability), 9 (Indemnification), and 13 (Governing Law) survive termination.
12. Privacy
Your use of CaveFinder is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the service shall be resolved as follows:
- Good-faith negotiation — the parties shall first attempt to resolve the dispute through informal negotiation for a period of at least 30 days.
- Binding arbitration — if negotiation fails, the dispute shall be resolved by binding arbitration conducted in the State of New Mexico in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Buzzy LLC.
14. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify registered users by email at least 30 days before the changes take effect. Your continued use of the service after the effective date of revised Terms constitutes acceptance of the changes.
15. General Provisions
- Severability — if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Entire agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and Buzzy LLC regarding the service.
- Waiver — our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment — you may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Force majeure — we shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control.
